Appeals court upholds AAP infant formula victory

The U.S. Court of Appeals for the Ninth Circuit has upheld the jury's verdict in favor of the American Academy of Pediatrics in the antitrust lawsuit brought against the Academy and certain infant formula manufacturers by Nestlé Food Co.

Nestlé's appeal followed a June 1995 jury verdict, which found that the Academy did not conspire with Abbott Laboratories and other firms to prevent Nestlé from entering the U.S. infant formula market by prohibiting infant formula consumer advertising.
