Court case, negotiations heat up tobacco fight

AAP efforts to reduce tobacco access and use by young people intensified over the last three months, as a critical court decision was issued and settlement negotiations with the tobacco industry were revealed.

On April 25, a North Carolina judge declared that the Food and Drug Administration (FDA) does have the authority to regulate cigarettes and smokeless tobacco as drugs and drug delivery devices. The decision was rendered in response to a lawsuit the tobacco industry filed last year against FDA regulations aimed at reducing youth tobacco use. The Academy, along with other public health organizations, filed an amicus brief in support of the FDA.
